1. Parties and acceptance

These Terms apply between DMD.AD ("we") and every person or entity that creates an account or uses the service ("you"). By signing up or using the service you accept these Terms, the Privacy Policy, and the distribution agreement you sign. If they conflict, the distribution agreement prevails.

2. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your password secret and for all activity in your account.
• Label accounts are responsible for the artists they manage (Managed Artists) and for approving their releases.
• We may ask you to verify your identity before a release is distributed or a balance is paid out.

3. The service

We distribute your recordings to digital stores and streaming services (DSPs) through distribution partners, manage UPC/ISRC codes, and pass on the royalties we receive. We do not guarantee that any DSP will accept, display or promote a release; that decision belongs to each DSP.

4. Content and rights

• You keep ownership of your work. You grant us a non-exclusive licence to store, convert and distribute your content for the term of your agreement.
• You warrant that you own or have permission for all recordings, compositions, lyrics, samples and artwork you upload.
• You must not upload content that infringes copyright, trademarks or other rights, content that breaks the law, or content that impersonates another artist.

5. Streaming fraud

You must not use bots, stream farms, fake accounts or any other means to inflate play counts artificially. If a DSP or we detect such activity, releases may be removed, related royalties may be withheld or reversed, and the account may be closed.

6. Royalties, tax and payouts

• Royalties are calculated from DSP reports, minus the platform share for your plan and applicable taxes (including Indonesian PPh 23).
• Royalties reach your balance after we receive the DSP reports; timing follows each DSP's schedule.
• Payouts require a bank account that matches your account details and are subject to the minimum amount in force.
• We may correct balances if a DSP revises or claws back its reports.

7. Plans and payment

Plan prices, features and terms are shown on the plans page. Fees paid are non-refundable unless we decide otherwise or the law requires a refund.

8. Takedowns and termination

• Takedown requests are handled according to your agreement. A Free plan agreement does not allow takedowns before its term ends.
• We may suspend or close accounts that breach these Terms, with notice where possible.
• After an account is closed, releases may be removed from DSPs, and any valid balance is still paid out after deducting outstanding obligations.

9. Limitation of liability

The service is provided as is. To the extent permitted by law, we are not liable for indirect losses, loss of income caused by DSP decisions, or outages of third-party services. Our liability is limited to the plan fees you paid in the last 12 months.

10. Changes to these Terms

We may change these Terms. New versions are announced in the panel or by email/WhatsApp. Using the service after a change takes effect means you accept the new version.

11. Governing law

These Terms are governed by the laws of the Republic of Indonesia. Disputes are first settled amicably; failing that, by the competent district court.
